The essentials
A booking is for one named vehicle and its price is charged when you confirm. Cancel more than one hour before it starts for a full refund; cancel later but before the start for a 50% refund. A booking cannot be cancelled once it starts. Leave within the 15-minute grace period to avoid published overtime charges. Hosts must never clamp, block, confront or move a vehicle themselves. These terms govern your use of the StayNPark app and website. They incorporate our Fees & Protections, Refunds & Cancellations and Privacy Policy. StayNPark connects drivers ("Parkers") with people offering private parking spaces ("Hosts") in Australia. All prices are in Australian dollars (AUD) and include GST where applicable.
What StayNPark is
StayNPark provides marketplace tools for search, booking, payment, navigation, messaging and issue reporting. The Host provides the parking service. A parking contract is formed between Parker and Host, with StayNPark facilitating and collecting eligible amounts on the Host's behalf. StayNPark does not own or control listed spaces and does not promise a real-time human response, alternative space or vehicle-removal service in every location.
Bookings, card charges and payment
- Before confirmation, we show the booked price and the material rules that can create an additional charge. When a booking is confirmed, the booked price is charged immediately to the selected card.
- A card statement may show the booking payment as pending while the bank processes it. This does not change the confirmed booking or the cancellation rights below. StayNPark does not release the Host share at confirmation; it becomes payout-eligible only after the stay and applicable incident-reporting window, subject to refunds, disputes, eligibility checks and Stripe's banking schedule.
- A booking lets the named vehicle occupy the listed private space only for the booked window. The 15-minute departure grace period delays overtime charging but does not extend that window. Arriving early or staying longer requires the Host's agreement and, where available, a confirmed extension in the app.
- An extension is effective only after it is confirmed and paid. Its price is shown before purchase.
- By confirming a booking, you authorise the immediate booked-stay charge. The cancellation policy determines how much of that charge is refunded. By saving a card, you also authorise the deterministic overtime parking and one-time overstay-administration charges specifically disclosed in these terms and at booking. Eligible later charges may be processed off-session after the relevant conditions are verified. We send an itemised receipt and provide a dispute route. A variable damage, cleaning, access, towing or storage claim is not charged merely on allegation; the evidence-and-response process below applies first. Removing a card does not cancel amounts already properly incurred.
- StayNPark does not add a card surcharge or payment-failure fee. We may retry a failed payment and restrict future bookings until an amount properly due is resolved.
Parker cancellations and no-shows
- More than one hour before the start: the booked amount is refunded in full to the original payment method.
- One hour or less before the start: 50% of the booked stay is payable. The Host receives 82.5% and StayNPark retains 17.5% of that cancellation amount.
- At or after the start, including a no-show: the booking can no longer be cancelled and the booked price remains payable because the space was reserved. We do not stack a separate no-show penalty on top.
If the Host cancels or the space is unavailable
If a Host cancels, or the booked space is materially inaccessible or unavailable on arrival, the Parker may report it in the booking and receive a full refund after verification. The Host receives no payout for that stay and repeated host-fault incidents may lead to listing or account controls. StayNPark may help identify another listing but does not guarantee one or promise to cover every rebooking cost. Reasonable, documented direct rebooking costs caused by Host fault may be assessed against the Host only after notice and an opportunity to respond.
Grace period, overtime and escalation
- There is no overtime charge during the first 15 minutes after the booked end time.
- After that grace period, overtime is calculated in each started 15-minute block at 1.5 times the booked hourly rate. Automated overtime parking charges are capped at A$150 for one booking.
- A separate, one-time A$15 overstay incident administration fee may apply and is retained by StayNPark. It does not compound and may be waived where evidence shows circumstances outside the Parker's reasonable control.
- The A$150 cap does not include the A$15 administration fee or an approved actual-cost claim for damage, cleaning, access restoration, towing or storage.
At 30 minutes overdue a Host can report the overstay; at 60 minutes it can be escalated to support; and at two hours StayNPark may assess whether a lawful third-party removal route exists. This timeline is not permission to tow, does not declare a vehicle abandoned and does not guarantee removal. Removal booking is disabled unless an applicable state process and vetted provider route are available.
A Host must never personally tow, clamp, block in, enter, damage or move a vehicle, or confront its Parker. Where there is an immediate safety danger, contact emergency services. If StayNPark confirms that a lawful removal can proceed, only the actual invoiced cost charged by a vetted third-party towing or storage provider may be passed through, without StayNPark markup.
Damage, cleaning and access claims
A Host or Parker seeking variable costs for physical damage, unusual cleaning or access restoration must report the incident within 24 hours and provide time-linked photos, relevant messages, a clear explanation and a reasonable invoice or quote. Claims cannot include ordinary wear, pre-existing damage, upgrades or unsupported estimates. The other party normally has 48 hours to respond.
An allegation does not trigger an instant charge. StayNPark reviews the evidence and responses before deciding whether an actual, reasonable cost is payable. We give notice of the outcome and a way to dispute it. This process does not prevent either party from exercising rights available under the Australian Consumer Law or other law.
Spot Requests and SpotHold
A Spot Request may broadcast limited request details to eligible nearby Hosts. A Host response is a provisional match, not a confirmed booking, until the Parker confirms and the required payment step succeeds; a request may expire first. SpotHold can help a Host confirm access or use a physical holder, but it is not custody, security, insurance or a guarantee that access will be uninterrupted.
Host obligations
- You must own the private, off-street space or have authority to offer it. Public street parking cannot be listed. Check any lease, strata, body corporate, council, planning and insurance restrictions before listing.
- Provide identity, tax and payout information reasonably required by law or our payment provider. If StayNPark asks you to provide an ABN, it must be valid and yours to use. You remain responsible for your own income tax and GST obligations.
- Keep the listing accurate, safe, accessible and clear for confirmed bookings, including dimensions, photos, access instructions, features, price and availability.
- Eligible booking, extension and overtime parking revenue is split 82.5% to the Host and 17.5% to StayNPark. Late-cancellation amounts use the same split. The A$15 incident-administration fee belongs to StayNPark. Approved actual costs go to the affected party or provider as appropriate.
- You indemnify StayNPark against claims caused by an inaccurate or unauthorised listing or your breach, only to the extent permitted by law.
Parker obligations
- Park only the registered, roadworthy and lawfully insured vehicle named in the booking, and use the space only for parking.
- Follow the access instructions, remain within the marked space and leave by the booked end time. The 15-minute grace period delays overtime charging only and does not extend the booking or permission to occupy the space.
- Do not leave hazardous, illegal or offensive material, perform repairs, obstruct access or damage the space or any access device.
Acceptable use, reports and safety
Listings, photos, reviews and messages must be accurate, lawful and respectful. Use the app's messaging and issue-reporting tools and avoid direct confrontation. We prioritise active-booking and safety reports, but response times vary and StayNPark is not an emergency or real-time response service. Call 000 for an immediate threat to life or safety. We may remove content or suspend accounts that create risk or breach these terms or the law. By uploading content, you give StayNPark a non-exclusive, royalty-free licence to display it for operating and promoting the platform.
Suspension and termination
We may suspend or close an account used fraudulently, in breach of these terms or in a way that creates risk—immediately for a serious issue, otherwise with reasonable notice where practicable. You may close your account in the app, but accrued payment, claim and dispute obligations continue. Clauses intended to survive termination do so.
Insurance
StayNPark is not an insurer and does not provide vehicle, property, public-liability or damage insurance. Hosts must check their own property, landlord, strata or business cover; Parkers remain responsible for appropriate vehicle insurance. SpotHold, identity verification, measurements and reviews are information or access tools, not insurance or guarantees.
Liability and Australian Consumer Law
StayNPark does not own or control spaces and is not responsible for a Host's or Parker's conduct except to the extent loss is caused by StayNPark or liability cannot lawfully be excluded. To the extent permitted by law, StayNPark is not liable for indirect or consequential loss. Nothing in these terms excludes, restricts or modifies rights or remedies that cannot be excluded under the Australian Consumer Law. Where the law permits a consumer guarantee remedy to be limited, our liability is limited to supplying the relevant service again or paying the reasonable cost of having it supplied again.
Receipts, complaints and disputes
We provide receipts for booking and additional charges. Check the booking record and contact support@staynpark.app if you believe an amount is wrong. Include the booking reference and any supporting evidence. We will review the transaction and explain the outcome; you also retain any card-dispute and legal rights.
General
Hosts and Parkers are independent parties. Nothing creates employment, partnership or joint venture, or agency beyond StayNPark's limited role in facilitating the marketplace and collecting amounts. A party is not responsible for delay caused by events beyond reasonable control, except for obligations already incurred. If one provision is invalid, the remainder continues. These terms are governed by the laws of Victoria, Australia, without limiting any non-excludable right to use another competent tribunal or court.
Changes and contact
We may update these terms. We will identify the policy version and give notice of a material change before it applies; where required, we will ask you to accept it before a new booking or listing. Questions: legal@staynpark.app · StayNPark, Melbourne, Victoria, Australia.
